1. Scope of Application

These terms and conditions of sale apply to all commercial transactions concluded between the Fromagerie de Martigny SA (hereinafter referred to as "the Seller") and its customers (hereinafter referred to as "the Customer") for the purchase of products from its establishment located at Rue des Planches 2, 1920 Martigny, Switzerland.

2. Orders

Any order placed by the Customer is considered an offer to purchase the specified products under the terms of these general terms and conditions of sale. The Seller reserves the right to accept or reject any order, in whole or in part, without having to provide justification.

3. Prices

The prices of the products are indicated in Swiss francs (CHF) and are those in effect at the time of order placement. The indicated prices do not include delivery charges, unless otherwise stated. The Seller reserves the right to change prices at any time without prior notice.

4. Payment

Payment for the ordered products must be made in full at the time of order placement. Payment cannot be withdrawn until the product is shipped. Payments can be made by Visa, Mastercard, or TWINT. In case of non-payment, the Seller reserves the right to suspend or cancel the order.

5. Shipping

The Seller offers a single shipping option: expedited shipping, 2 to 3 business days. Delivery times are provided for reference and do not constitute a firm commitment from the Seller. The risk of loss or damage to the products is transferred to the Customer upon delivery. The Customer has 48 hours after receipt to report any issues with the goods.

6. Right of Withdrawal

In accordance with applicable law, the Customer has a 14-day withdrawal period from the date of receipt of the products to exercise their right of withdrawal, without providing a reason. The Customer must inform the Seller of their decision to withdraw in writing. Returned products must be in their original condition and accompanied by their original packaging.

7. Warranty

The Seller guarantees that the delivered products are in conformity with their description and free from manufacturing defects at the time of delivery. In case of non-conformity or defects, the Customer must inform the Seller as soon as possible to resolve the issue. The Seller's liability is limited to the replacement or refund of defective products.

8. Return Address

Products returned under the right of withdrawal or for complaints must be sent to the following address: Fromagerie de Martigny SA, Rue des Planches 2, 1920 Martigny, Switzerland. The Customer is responsible for return costs unless otherwise specified by the Seller.

9. Complaints

In case of a complaint, the Customer must contact the Seller's customer service at info@fromageriedemartigny.ch or through the website, via the contact form. The Seller is committed to responding to complaints within a reasonable timeframe and finding a satisfactory solution for the Customer.

10. Liability

The Seller shall not be held liable for indirect or intangible damages resulting from the use of the products sold. The Seller's liability is in any event limited to the order amount.

11. Data Protection

The Seller is committed to protecting the confidentiality of the Customer's personal data and using it only for order fulfillment. The Customer's personal data will not be shared with third parties without their prior consent.

12. Applicable Law and Jurisdiction

These terms and conditions of sale are governed by Swiss law. In case of a dispute, the parties will endeavor to resolve their differences amicably. Failing amicable agreement, any dispute relating to these general terms and conditions of sale will be submitted to the exclusive jurisdiction of the competent courts in Martigny, Switzerland.
